Traffic
Minor Traffic Tickets or Citations
Most everybody who drives a car gets a traffic ticket,
also known as a traffic citation. Some traffic tickets
are crimes with criminal penalties, such as Driving
While Intoxicated (DWI). However, most traffic tickets
are violations resulting in fines, such as speeding
and running a red light.
There are three primary reasons
to have an attorney for traffic tickets.
First, if you get a traffic ticket
and you plead guilty, the Department of Motor Vehicles
(DMV) will assign you a certain number of “points”
which will go on your driving record. If you receive
too many points on your driver’s license, the
DMV will revoke your license. Therefore, whenever
you get a ticket, it is advisable for you to hire
an attorney who will fight to get the charge reduced
or dismissed so you do not accumulate points on your
license.
Second, your auto insurance rate will
increase if you receive points on your license. In
fact, your insurance company can cancel your auto
insurance policy altogether if you have too many points
on your licence.
Third, if you are involved in an auto
accident and you get a ticket, it is absolutely essential
that you have an attorney represent you; auto accidents
often result in lawsuits. If you just plead guilty
to the charge, your admissions and conviction can
be used against you in a civil lawsuit. Our firm will
help you to avoid serious financial liability should
a civil lawsuit arise.
By contacting our office about your
traffic ticket, we will talk with you about how you
can avoid points on your license, avoid increased
insurance costs, and avoid suspension or revocation
of your driver’s license.
Criminal Misdemeanor Traffic
Tickets
Misdemeanor traffic offenses are much more serious
than basic traffic infractions. A person’s first
conviction for a traffic infraction, such as speeding,
will usually result in fines and points on his or
her record and rarely result in jail time. Misdemeanor
traffic offenses, however, can result in fines, jail
time and can leave a person with a permanent criminal
record.
The McHugh Law Firm, P.C. can help
you with misdemeanor traffic charges, such as reckless
driving, leaving the scene of an accident involving
a personal injury, and DWI, to name a few. We also
handle traffic-related felonies, such as driving with
a suspended license.
If you plead guilty to a criminal traffic
violation, the court will most likely give you the
standard fines, points on your license, and possibly
jail time, without giving you the opportunity to present
your side of the story.
Once our firm is hired to represent
you, we will work to convince the court and/or the
prosecuting attorney to dismiss the charges against
you, and if that cannot be achieved, we will work
to reduce the charges against you.
